There are rules for where you CAN'T drive and that includes most areas outside of roads and parking lots and such.

In some states, you'll get a ticket for driving off road vehicle unless you have an off-road vehicle (ORV) sticker unless you're on private property.

Does it have to be your own private property or do I need an off road license for someone else’s private property?

That would be trespassing. I'm referring to public lands or even on lakes when they are frozen in the winter.

A lack of it wasn’t either. There is no objective reason to favor one over the other. It is also entirely incidental to the original question.
